All legal services are provided under a legal assistance contract. An invoice is issued for the payment of fees. VAT is added to the fee, which represents an indirect tax collected by the lawyer and remitted to the state budget. Fees can be paid via bank transfer (preferred method) or in cash, within the limits prescribed by current legislation.
The types of fees are:
- hourly fees;
- fixed fees (lump sum);
- success fees.
Hourly fee is commonly used in legal activities where the lawyer cannot accurately predict the amount of time required to provide services. It may be calculated based on overhead costs, the lawyer’s experience and reputation, the complexity of the case, and other relevant criteria.
A fixed fee (lump sum) is typically applied in situations where the usual time consumption in certain types of cases can be known or estimated.
There are cases where, despite the nature of the dispute suggesting an hourly rate calculation, due to the complexity of the case and its unpredictability over time, a mixed form of billing is negotiated, combining an hourly rate and a percentage under a fixed fee arrangement.
A success fee is typically established in cases involving a high degree of legal innovation or facing a challenging legal situation. It represents an additional fee on top of the basic fee (hourly or fixed) and is paid upon achieving the desired outcome.
